On December 31, 1981, plaintiff, Cecelia L. Temborius, filed this lawsuit against all the defendants herein alleging, after amendment of her complaint, breach of contract, misrepresentation, violation of the Consumer Protection Act, conspiracy, negligence, and breach of a bailees duties. Defendant Motor City Auto Brokers (hereafter Motor City) was dismissed as a party defendant, as was defendant Susan Slatkin. According to the record, Norton Slatkin (hereafter Slatkin) was involved in a personal bankruptcy proceeding, but he was not dismissed as a defendant. Following a jury trial on December 3 and 4, 1984, a verdict was rendered in favor of plaintiff and against defendant Bob Fruin Buick-Pontiac, Inc. (hereafter Fruin) in the amount of $38,000, which included attorney fees. Defendant Fruin appeals as of right.
